Terms & Conditions

  1. Acceptance of Terms 

By downloading, installing, accessing, or using the LAMS Survey mobile application (the “App”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between 

you (“User”, “you”, or “your”) and Simpro Business Solutions Private Limited (“Company”, “we”, “our”, or “us”). 

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP. 

  1. Purpose and Scope of the App 

The LAMS Survey App is a specialized enterprise application designed exclusively for authorized personnel to 

conduct land acquisition and management surveys. The App facilitates: 

  • Collection of property measurements and dimensions 
  • Documentation of family and household information 
  • Asset recording and valuation 
  • Geo-tagged photography and imagery 
  • Real-time data synchronization with cloud servers
  • Survey status tracking and reporting 

 

  1. Eligibility and Authorization 

Use of the App is restricted to: 

  • Authorized employees, contractors, or agents of organizations with valid survey projects 
  • Individuals who have received valid login credentials from their organization 
  • Users who are at least 18 years of age 
  • Users with devices meeting minimum technical requirements 

Unauthorized use of the App is strictly prohibited and may result in legal action. 

  1. User Accounts and Access 

4.1 Account Registration 

  • You must register with valid credentials provided by your organization 
  • All information provided must be accurate, current, and complete 
  • You must update your information promptly if it changes 

4.2 Account Security 

  • You are responsible for maintaining the confidentiality of your account credentials 
  • You must not share your login credentials with any other person 
  • You are responsible for all activities that occur under your account 
  • You must notify us immediately of any unauthorized access or security breach 

4.3 Account Suspension 

We reserve the right to suspend or terminate accounts for violations of these Terms, suspicious activity, or at the 

request of your organization. 

  1. Authorized Use 

You agree to use the App only for legitimate survey purposes and in compliance with: 

  • All applicable laws and regulations
  • Your organization’s policies and procedures 
  • Professional and ethical standards 
  • Privacy and data protection laws 

Specifically, you agree to: 

  • Provide accurate and truthful information in all surveys 
  • Respect the privacy and property rights of survey subjects 
  • Obtain necessary permissions before capturing images of people or private property 
  • Handle all collected data with appropriate care and confidentiality
  • Use the App only during authorized working hours and locations 

 

 

 

  1. Prohibited Activities 

YOU MUST NOT: 

  • Unauthorized Use: Use the App for any purpose other than authorized survey activities 
  • Data Misuse: Share, distribute, sell, or transfer collected data without authorization 
  • Security Bypass: Attempt to bypass, disable, or circumvent any security measures, including root detection 
  • False Information: Upload false, misleading, fraudulent, or inaccurate information 
  • Compromised Devices: Use the App on rooted, jailbroken, or otherwise compromised devices 
  • Reverse Engineering: Reverse engineer, decompile, disassemble, or modify the App 
  • Interference: Interfere with App functionality or other users’ access 
  • Legal Violations: Violate any privacy, data protection, or other applicable laws 
  • Debugging Tools: Use memory dumping, debugging, or hacking tools on the App 
  • Malicious Code: Introduce viruses, malware, or any malicious code 
  • Automated Access: Use bots, scripts, or automated tools to access the App 

  1. Security Requirements 

IMPORTANT SECURITY NOTICE: 

The App implements strict security measures to protect sensitive survey data. Compliance with these 

requirements is mandatory. 

7.1 Device Requirements 

  • No Rooted/Jailbroken Devices: The App will not function on rooted (Android) or jailbroken (iOS) devices 
  • SSL Pinning: The App enforces SSL certificate pinning to prevent man-in-the-middle attacks 
  • Secure Environment: You must maintain a secure device environment 
  • Updated Software: Keep your device OS and the App updated with latest security patches 

7.2 Security Responsibilities 

  • Report any security vulnerabilities immediately to: sandip@simpro.co.in or sudhindra@simpro.co.in 
  • Do not attempt to test security measures without written authorization 
  • Lock your device when not in use 
  • Do not install the App on shared or public devices 
  • Log out when your work session is complete 

 

 

 

  1. Data Collection and Usage 

8.1 Your Consent 

By using this App, you explicitly consent to the data collection practices described in our Privacy Policy, including: 

  • Collection of precise GPS location with all images 
  • Access to device camera and photo storage 
  • Storage of survey data in cloud servers 
  • Device information collection for security purposes 

8.2 Data Accuracy 

You are responsible for the accuracy and completeness of all data you collect and submit through the App. 

8.3 Survey Subject Consent 

You are responsible for obtaining appropriate consent from survey subjects before: 

  • Capturing photographs of individuals 
  • Collecting personal or household information 
  • Entering private property 
  • Recording sensitive information 

 

 

 

  1. Location Services 

The App requires continuous access to location services for core functionality: 

  • Mandatory Requirement: Location services cannot be disabled during survey operations 
  • GPS Coordinates: All images are automatically tagged with precise GPS data 
  • Address Data: Complete address information is captured and stored.
  • Verification Purpose: Location data is used to verify survey authenticity 

By using the App, you consent to continuous collection and storage of location data during survey activities. 

  1. Image and Photo Usage 

10.1 Image Rights 

  • All images captured through the App become part of official survey records 
  • You transfer all rights, title, and interest in survey images to the project owner
  • Images may be stored, accessed, and used by authorized project personnel 
  • You retain no ownership or intellectual property rights over survey images 

10.2 Image Requirements 

  • You must obtain consent before photographing people
  • You must respect privacy when capturing images of private property 
  • Images must be relevant to survey purposes 
  • You must not capture inappropriate or offensive content 

  1. Intellectual Property 

11.1 App Ownership 

The App and all its components, including but not limited to: 

  • Software code and architecture 
  • User interface and design 
  • Trademarks, logos, and branding 
  • Documentation and content 

are owned by Simpro Business Solutions Private Limited and are protected by intellectual property laws. 

11.2 License Grant 

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for authorized 

survey purposes. 

11.3 Restrictions 

You may not: 

  • Copy, modify, or create derivative works of the App 
  • Distribute, sell, lease, or sublicense the App 
  • Remove or alter any proprietary notices 
  • Use the App to develop competing products 

 

 

  1. Data Security and Backup 

12.1 Our Security Measures 

We implement comprehensive security measures including: 

  • Encryption of data in transit and at rest
  • Regular security audits and penetration testing 
  • Access controls and authentication systems
  • Monitoring and incident response procedures 

12.2 No Absolute Security 

However, no system is completely secure. We do not guarantee absolute security. 

12.3 Your Responsibilities 

You should maintain local backups of important data when possible 

  • Report any security concerns immediately 
  • Do not store sensitive data on unsecured devices 

 

 

 

  1. Service Availability 

We strive to provide uninterrupted service, but: 

We do not guarantee 100% uptime or availability 

  • Scheduled maintenance may cause temporary disruptions 
  • We reserve the right to modify or discontinue features with or without notice 
  • Offline functionality may be limited 
  • Network connectivity issues may affect performance.                                                  
  1. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW: 

  • We are not liable for indirect, incidental, consequential, or punitive damages 
  • We do not guarantee the accuracy of GPS coordinates or survey data 
  • You use the App at your own risk 
  • We are not responsible for decisions made based on survey data 
  • Our total liability shall not exceed the fees paid for the service (if any) 
  • We are not liable for data loss due to technical issues, device failure, or user error 
  • We are not liable for any damages resulting from unauthorized access to your account 

  1. Indemnification 

You agree to indemnify, defend, and hold harmless Simpro Business Solutions Pvt. Ltd., its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: 

  • Your violation of these Terms 
  • Your misuse of the App or collected data 
  • Your violation of any laws or third-party rights 
  • Survey data you collect, provide, or process
  • Any negligent or wrongful acts or omissions 
  • Your breach of confidentiality or data protection obligations 

  1. Termination 

16.1 Termination by Us 

We may terminate or suspend your access immediately, without prior notice, if: 

  • You violate these Terms 
  • You misuse the App or data 
  • Required by law or regulatory authority 
  • Your employment or contract with the authorizing organization ends 
  • We suspect fraudulent or malicious activity 
  • The service is discontinued 

16.2 Effect of Termination 

Upon termination: 

  • You must immediately cease all use of the App 
  • You must uninstall the App from all devices
  • All licenses granted to you terminate immediately 
  • Your account and access credentials will be deactivated 
  • You must return or destroy any confidential information 

16.3 Survival 

Sections regarding intellectual property, indemnification, limitation of liability, and confidentiality shall survive 

termination.

 

  1. Updates and Modifications 

17.1 App Updates 

We may update the App at any time to improve functionality, security, or compliance 

  • Updates may be automatic or require manual installation 
  • Continued use after updates constitutes acceptance of changes 

17.2 Terms Modifications 

  • We may modify these Terms at any time 
  • Material changes will be communicated through the App or email 
  • Continued use after changes constitutes acceptance 
  • You should review these Terms periodically 

  1. Disclaimers and Warranties 

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER 

EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: 

  • Warranties of merchantability 
  • Fitness for a particular purpose 
  • Non-infringement 
  • Accuracy or reliability of data 
  • Uninterrupted or error-free operation 

  1. Force Majeure 

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable 

control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, power failures, or 

internet service provider failures. 

  1. Governing Law and Jurisdiction 

20.1 Governing Law 

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. 

20.2 Jurisdiction 

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the 

competent courts in Bangalore, Karnataka, India. 

20.3 Dispute Resolution 

Before initiating legal proceedings, parties agree to attempt good faith negotiations to resolve any disputes. 

  1. Miscellaneous 

21.1 Entire Agreement 

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Simpro Business Solutions Pvt. Ltd. regarding the App. 

21.2 Severability 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in 

full force and effect. 

21.3 Waiver 

No waiver of any term shall be deemed a continuing waiver of such term or any other term. 

21.4 Assignment 

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without 

restriction. 

21.5 Third–Party Beneficiaries 

These Terms do not create any third-party beneficiary rights.
